These Terms of Service (“Terms”) govern your access to and use of websites, digital software, and mobile applications operated by MGM Innovations, a Partnership Firm registered under the Indian Partnership Act, 1932, with its principal place of business at Haldwani, Uttarakhand, India (“Firm”, “We”, “Us”, or “Our”), including our main domain (mgminnovations.com) and products such as BimaGenius (bimagenius.com).

By accessing or using our website, APIs, or software applications, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use our services.

1. Technology Provider Status & Regulatory Disclaimer

MGM Innovations is strictly a technology software developer. Our platforms, including BimaGenius, provide digital utilities, calculation software, and management tools for insurance advisors and businesses.

MGM Innovations is not an insurer, insurance broker, corporate agent, or insurance intermediary, and is not regulated as such by the Insurance Regulatory and Development Authority of India (IRDAI). We do not solicit, sell, underwrite, or bind insurance contracts. All insurance policies, rates, and coverage remain subject to the respective underwriting guidelines of licensed insurance companies and prevailing IRDAI regulations.

2. Account Registration & Security

To access certain features of our applications, you may be required to register using a valid Indian mobile number and authenticate via One-Time Password (OTP). You are responsible for safeguarding your login credentials and for all activities that occur under your account.

3. Intellectual Property Rights

All intellectual property rights in and to our websites, proprietary software architectures, AI algorithms, calculation engines, user interfaces, logos, and visual trademarks (including MGM Innovations and BimaGenius) are and remain the exclusive property of MGM Innovations. You may not copy, reverse engineer, decompile, or create derivative works from our software.

4. Acceptable Use Policy

You agree not to:

  • Use our platforms for any unlawful, fraudulent, or harmful purposes.
  • Interfere with, disrupt, or compromise the integrity or security of our cloud systems or APIs.
  • Scrape, crawl, or harvest data through unauthorized automated means.
  • Upload any content or files that violate the rights of any third party or contain malicious code.

5. Limitation of Liability

To the maximum extent permitted by applicable Indian law, MGM Innovations and its partners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our platforms or software calculations. Users are advised to verify final policy terms and premiums directly with official insurer portals before issuance.

6. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any disputes arising out of or in connection with these Terms or the use of our services shall be subject to the exclusive jurisdiction of the competent courts in Haldwani / Nainital, Uttarakhand, India.
